TRUtesting | A Unit of Edubrahma Innovations Pvt. Ltd.

This document is published in accordance with the provisions of the Information Technology Act, 2000 and the Information Technology (Intermediaries Guidelines) Rules, 2011. By registering and making payment, you enter into a legally binding agreement with EduBrahma Innovations Private Limited.

1. Acceptance of Terms

By accessing or registering for TRUtesting, you agree that these Terms and Conditions govern all aspects of your registration, participation, payment, and usage of the platform. They constitute the entire agreement between you and EduBrahma Innovations Private Limited and override any prior oral, written, or implied representations. Your act of registration and payment is conclusive proof of acceptance of these Terms, and no modifications, exceptions, or verbal assurances shall have any validity unless expressly issued in writing by the Company.

2. Eligibility and User Responsibility

Use of TRUtesting is open to all individuals who are competent to contract under the Indian Contract Act, 1872. By registering, you confirm that the details you provide are true, complete, and accurate, and that you are legally authorised to enter into this agreement on behalf of yourself or your ward. You agree to safeguard your login credentials, and any activity conducted through your account shall be treated as validly authorised by you.

3. Nature of Service and Completion of Delivery

TRUtesting is an independent aptitude and benchmarking diagnostic platform. The service is deemed to be delivered at the time of registration and payment, when your details are entered into the TRUtesting system, your profile is created, and your eligibility to participate in the benchmarking test is secured. The examination itself, the diagnostic report, analytics, and benchmarking outcomes are subsequent features and outputs, but the primary service obligation is considered fully discharged upon registration. For clarity, this test is purely diagnostic in nature and is not to be construed as a certification, guarantee, or predictive tool for future success.

4. Intellectual Property Ownership

All intellectual property rights in TRUtesting, including its platform, technology, processes, designs, graphics, content, test questions, assessment frameworks, ranking algorithms, reports, and analytics, are the sole property of EduBrahma Innovations Private Limited. By registering, you obtain no ownership rights, license, or entitlement to the intellectual property other than limited usage rights expressly permitted. Any unauthorised reproduction, modification, distribution, or derivative works, whether commercial or non-commercial, constitute a breach of these Terms and shall attract legal consequences.

5. Website License

Subject to your full compliance with these Terms, TRUtesting grants you a limited, revocable, non-transferable license to access and use the website for personal, non-commercial purposes only. You shall not sublicense, sell, resell, copy, reverse-engineer, or misuse the platform in any manner. You may not design or build any competing service using TRUtesting's intellectual property. Any attempt to do so shall lead to immediate suspension of your account and legal action for infringement.

6. Finality of Payments

All payments to TRUtesting are strictly final, non-refundable, and nontransferable. Once registration is completed, you will not be entitled to claim refunds, cancellations, or adjustments on any ground whatsoever. This includes cases where you fail to appear for the test, choose not to access your report, later express dissatisfaction, or change your mind after payment. The policy is aligned with practices followed by airlines, hotels, travel portals, and exam boards, where booking itself constitutes service delivery.

7. No Chargeback Policy

By completing payment, you waive the right to raise chargebacks with your bank, card provider, or payment gateway, except in cases of proven unauthorised transactions such as fraud. Claims of "service not delivered," "unsatisfactory service," or "change of decision" are expressly invalid, since TRUtesting's service is deemed fully delivered at the point of registration. Any unjustified chargeback filed shall be treated as fraud against EduBrahma Innovations Private Limited, entitling the Company to suspend your account, forfeit your fees, and recover legal costs and damages.

8. Conditions for Use of Website

You undertake not to misuse the TRUtesting website or platform in any manner. You shall not host, upload, publish, transmit, or share any content that is defamatory, obscene, illegal, infringes third-party rights, or violates Indian law. You shall not introduce viruses, bots, scripts, or disruptive mechanisms that impair website operation. You shall not impersonate another user, mislead others, or attempt unauthorised access. Any violation shall result in immediate suspension without prior notice and may attract civil or criminal liability.

9. Confirmation of Service and Evidence

Upon successful payment, TRUtesting will issue a confirmation via email and/or SMS, which constitutes acknowledgement of service delivery. The Company maintains comprehensive logs, records, timestamps, and system-generated evidence of registration, access, and report generation, which shall be deemed conclusive proof of delivery in case of disputes. These records may be presented to banks, arbitrators, or courts to contest false claims, and you expressly consent to their admissibility.

10. Indemnity, Limitation of Liability, and Disclaimer

You agree to indemnify EduBrahma Innovations Private Limited, its officers, employees, and affiliates against any claims, damages, or liabilities arising from your misuse of TRUtesting, breach of Terms, or wrongful attempts to reverse payments. The Company's liability, under any circumstances, is limited strictly to the registration fee received. TRUtesting does not guarantee or assure success in Board Examinations, Scholastic Tests, Competitive Examinations, or Entrance Examinations. The test is purely diagnostic and reflects performance on the date of evaluation. By accepting these Terms, you undertake not to hold TRUtesting responsible for your performance or outcomes in any such external examinations. You further acknowledge that TRUtesting does not challenge or dispute the results, admissions, intake processes, or decisions of any board, school, university, or institution.

11. Consequences of Breach of Terms

Any breach of these Terms shall entitle EduBrahma Innovations Private Limited to take immediate action, including suspension or permanent blocking of your account, forfeiture of fees paid, and initiation of legal proceedings for recovery of damages. Fraudulent actions such as impersonation, false claims, or unjustified chargebacks may also result in referral to law enforcement authorities. The Company reserves the right to protect its interests and reputation through civil and criminal remedies.

12. Deficiency in Service

While TRUtesting strives to ensure smooth operation of its website and test delivery, you acknowledge that temporary outages, maintenance, or technical issues may arise. Such interruptions shall not be treated as deficiency in service. TRUtesting disclaims liability for external failures including internet connectivity, power outages, or third-party errors beyond its control. No refunds, damages, or claims shall arise from such circumstances.

13. Communication Policy

All official communication from TRUtesting will be through designated channels such as email, SMS, or in-platform notifications. TRUtesting does not appoint personal counsellors for career counselling, nor does it allow communication outside its official systems. Any advice, guidance, or communication not originating from TRUtesting's official domain shall not be considered valid or binding. You agree not to misuse TRUtesting communication systems for spam, solicitation, or unauthorised messaging.

14. Dispute Resolution

In the event of disputes, you agree to first seek resolution directly with TRUtesting. If no resolution is possible, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator appointed by EduBrahma Innovations Private Limited, seated in Mumbai, India, with proceedings conducted in English. The arbitrator's award shall be final and binding.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of India. You agree that all disputes, claims, or proceedings shall be subject to the exclusive jurisdiction of the courts in Mumbai. You further acknowledge that the final interpretation, enforcement, and jurisdiction for all matters relating to TRUtesting rest solely with EduBrahma Innovations Private Limited, and no external assurances shall override this clause.

16. Acknowledgement of Agreement

By clicking "Register," completing payment, or otherwise using TRUtesting services, you acknowledge that you have read and understood these Terms and Conditions fully, that you are registering of your own free will after exercising due diligence, and that you are bound by a no-refund, no-cancellation, and no-chargeback policy. You further confirm that the only binding source of information about TRUtesting is its official website and these Terms and Conditions, and that no verbal or informal assurance of any kind shall bind the Company.
